Welcome to Nexa Futbol, a nutrition, training, and recovery app for soccer players ages 13–18 ("the Service"). The Service is provided by Nexa Futbol, a sole proprietorship operated by Joseph Posel based in Florida, United States ("Nexa Futbol," "we," "us"). By creating an account or using the Service, you are entering into an agreement with Nexa Futbol on these Terms. If you do not agree, please do not use the Service.
Because many of our users are teenagers, we've kept these Terms as readable as we can. Questions are always welcome at josephposel@gmail.com.
1. Who can use Nexa Futbol
The Service is intended for soccer players between 13 and 18 years old. You must be at least 13 to create an account. If you are under 18, you may only use the Service if your parent or legal guardian has reviewed and agreed to these Terms on your behalf, where the law where you live requires their consent. Parents and guardians who permit a minor to use the Service agree to these Terms for them and are responsible for the minor's use of the Service — including any paid subscription purchased through the account.
You agree to provide accurate information when creating your account and profile, and to keep your login method (your email inbox or Google account) secure. You are responsible for activity that happens under your account.
2. Not medical advice
Nexa Futbol provides general nutrition, training, and recovery information for educational purposes only. It is not medical, dietetic, or professional advice, and it is not a substitute for guidance from a doctor, registered dietitian, or other qualified professional.
Calorie and nutrition targets in the app are estimates calculated from general formulas. Every athlete is different. Before making significant changes to your diet or training — and especially if you have a medical condition, an injury, allergies, or any concerns about eating, weight, or body image — talk to a parent or guardian and consult a qualified professional. If you ever feel that tracking food or weight is causing you stress or unhealthy habits, please stop using the app and talk to a parent, doctor, or another trusted adult.
Never disregard professional advice, or delay seeking it, because of something you read in the Service.
3. AI features and accuracy
The Service uses artificial intelligence to analyze meals you log by photo, text, or voice, to estimate their nutritional content, and to generate personalized workout plans. AI-generated results are estimates and may be inaccurate or incomplete — for example, the AI may misidentify a food, misjudge a portion size, or suggest an exercise that is not appropriate for your body or ability. You should review AI results before relying on them, and you use them at your own risk. We do not guarantee the accuracy of any nutritional information, workout suggestion, or other AI output in the Service.
You are responsible for the content you submit to the AI features (meal photos, descriptions, voice input) and for how you act on the outputs. Do not submit content you do not have the right to submit. Do not use the AI features to attempt to generate illegal, harmful, or infringing content. We may remove content, filter outputs, or suspend accounts that misuse the AI features.
4. Your content
You keep ownership of the content you submit to the Service, such as meal photos and descriptions. By submitting content, you give us the limited permission we need to operate the Service — to store your content, transmit it to our AI and infrastructure providers for processing, and display it back to you. We do not use your content for advertising and do not sell it.
You agree not to upload content that is illegal, harmful, or infringes anyone else's rights.
5. Acceptable use
You agree to use the Service only for its intended purpose. You may not attempt to access other users' data, probe or disrupt the Service's security, use automated tools to scrape or overload the Service, misrepresent your age or identity, or use the Service for any unlawful purpose. We may suspend or terminate accounts that violate these Terms or that we reasonably believe put other users or the Service at risk.
6. Plans, pricing, and paid subscriptions
Nexa Futbol offers a Free plan and paid monthly subscriptions (currently Pro at $7.99/month and Max at $9.99/month). Current plans and prices are shown on the Pricing page. Paid subscriptions automatically renew each month at the then-current price until you cancel. You can cancel at any time from your account, and your paid access will continue through the end of the current billing period. We may change prices or plan features from time to time; changes to your subscription price take effect at your next renewal after we give you reasonable notice.
If you are under 18, you must have your parent's or guardian's permission before purchasing any paid subscription, and the purchase must be made or authorized by them where required by law.

7. Payments
Payments for paid subscriptions are processed by Stripe on our behalf. Stripe charges your card, calculates and collects applicable taxes, and issues receipts and invoices. Nexa Futbol is the seller of the subscription and remains responsible for providing the Service. Card details are handled by Stripe and are not stored on our servers.
8. Our intellectual property
The Service — including its software, design, name, logo, and content we create — belongs to us or our licensors and is protected by law. We grant you a personal, non-exclusive, non-transferable license to use the Service for your own personal, non-commercial use within your selected plan. You may not copy, modify, resell, redistribute, reverse-engineer, or circumvent technical limits of the Service except where the law allows it.
9. Suspension and termination
You can stop using the Service at any time and can delete your account from the Profile page, which deletes the data stored with it. We may suspend or terminate your access if you materially breach these Terms, if you fail to pay for a paid subscription, if we reasonably believe your account presents a security or fraud risk, or if you repeatedly or seriously violate our policies. We may also suspend or terminate access if we are required to by law or if we discontinue the Service. Where practical, we will give you reasonable notice so you can export or note down your data. Sections of these Terms that by their nature should survive termination (such as disclaimers and limitations of liability) will survive.
10. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and uninterrupted availability. We do not warrant that nutrition estimates, targets, workout suggestions, or recovery scores are accurate or suitable for your individual circumstances.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, arising out of or related to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) fifty US dollars (USD $50).
Some jurisdictions do not allow certain warranty disclaimers or liability limits — in those places, the above applies only to the extent permitted. If you are a consumer in the European Union or United Kingdom, nothing in these Terms limits your mandatory statutory rights, and nothing in these Terms excludes liability that cannot be excluded under applicable law (such as liability for gross negligence or intentional misconduct).
12. Governing law and disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Florida. If you are a consumer residing in the European Union or United Kingdom, you also benefit from any mandatory consumer protections of the country where you live, and you may bring proceedings in your local courts where the law gives you that right.
13. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and notify you in the app or by email. If you keep using the Service after changes take effect, that means you accept the updated Terms. If you don't agree, stop using the Service and delete your account.
